Biplanes – a dogfight game for two nearby phones

These Terms and Conditions (the “Terms”) are the agreement between you and HyperCode Solutions Kft. (“we”, “us”) about the game Biplanes for Android and iOS (the “App”). By installing or using the App you accept them. If you do not agree with them, do not use the App. How personal data is handled is described in the Privacy Policy.

In these Terms, a “Store” is Apple's App Store or Google Play, and a “Plane” is a plane that can be selected in the App.

2. The App

Biplanes is a dogfight for two players on two phones that are near each other, connected over Bluetooth Low Energy. It can also be played alone, against a computer opponent. An Android phone and an iPhone can play each other. The App needs no account.

3. Licence

The App is licensed to you, not sold. We give you a personal, limited, non-exclusive, non-transferable and revocable licence to install it on devices you own or lawfully use, and to use it for private, non-commercial purposes, in line with these Terms and with the rules of the Store you downloaded it from.

4. What two-player play needs

  • two devices, each with the App installed and open on the screen;
  • Bluetooth switched on and the Bluetooth permission granted on both devices (on Android 11 and older, also the Location permission and Location switched on);
  • the two devices being near each other;
  • to host a game, a phone whose Bluetooth hardware can advertise. Some Android phones cannot host a game, but they can join one.

How Bluetooth works depends on the devices, their software and the surroundings. We do not promise that any two devices can connect, that a connection holds, or that a match runs without delay. The App does not save a match: when both phones leave, it is over.

Nearby devices running the App can see a game in progress; section 4 of the Privacy Policy explains this.

5. In-app purchases

What you can buy. Further Planes. A Plane only changes how your aircraft looks. Every Plane flies the same and shoots the same; a purchase gives no advantage in the game. The first Plane is free, and the whole game can be played without buying anything.

One-time purchase. Each Plane is bought once. It is not a subscription, and it is not used up.

Tied to your Store account. A purchase belongs to the App Store or Google Play account it was made with. It cannot be moved between the App Store and Google Play, and it cannot be transferred to another person.

Restoring. If you have reinstalled the App or changed phones, sign in to the same Store account and tap Restore purchases on the Planes panel. Restoring needs an internet connection.

Prices. The price is the one the Store shows before you confirm the purchase, in the currency of your country. We may change the price of future purchases.

Payment. The Store processes the payment under its own terms. If the Store reports a payment as pending, the Plane is unlocked when the Store confirms it.

Refunds. You can ask the Store for a refund, under its rules: Apple, Google Play. You can also write to us, but only Apple can refund an App Store purchase. After a refund the Plane is locked again and your selection goes back to the free biplane.

Right of withdrawal (consumers in the EU). If you buy as a consumer, the law lets you withdraw from a distance contract within 14 days without giving a reason. A Plane is digital content that is not supplied on a tangible medium, and you get it immediately after payment. If you expressly agreed that performance begins at once, and acknowledged that you lose your right of withdrawal by this, the right of withdrawal ends when the Plane is unlocked. In Hungarian law this is governed by Section 20 and Section 29(1)(m) of Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses. The Stores describe in their own terms how they apply the right of withdrawal to purchases made through them.

If something is wrong. If a Plane you paid for is not unlocked, tap Restore purchases; if that does not help, write to us. These Terms do not affect the rights the law gives you when performance is defective.

6. Fair play and acceptable use

When using the App, you must not:

  • use the App for an unlawful purpose or to harass others, or choose a player name that is offensive or impersonates someone else;
  • copy, modify or reverse-engineer the App, unless the law allows it;
  • use a modified version, or a tool that interferes with a match or with the other player's phone;
  • obtain a paid Plane without paying for it;
  • sell, rent or sublicense the App.

The App has no server. One phone cannot check whether the other player has bought the Plane they fly. The licence does not cover a modified version of the App, and what such a version shows gives no right to any Plane.

7. Intellectual property

The App, its name, code, design and artwork belong to us or to our licensors, and are protected by copyright and other laws. Some of the artwork is used under a licence from its authors. These Terms give you no rights beyond the licence in section 3. Your player name remains yours.

8. Age

The App is not directed to children under 13. If you are not yet 18, you need the permission of your parent or guardian to buy. See also section 9 of the Privacy Policy.

9. The Stores

These Terms are between you and us, not between you and Apple or Google. The Store's own terms also apply to downloading the App and to purchases: Apple, Google Play.

  • Apple and Google have no obligation to provide maintenance or support for the App.
  • If you downloaded the App from the App Store: Apple is not responsible for claims relating to the App, and if someone makes an intellectual-property claim, investigating and settling it is not Apple's task either.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

10. Warranty

We make the App with due care, but we provide it as it is. Beyond what the law requires, we do not promise that it is free of errors, that it works on every device, or that it will always be available. This does not limit the rights the law gives you as a consumer when digital content is defective.

11. Liability

To the extent the law allows, we are not liable for indirect or consequential damage, loss of data or lost profit arising from the use of the App or from not being able to use it. Where our liability cannot be excluded but can be limited, it is limited to the amount you spent on purchases in the App in the twelve months before the claim.

These Terms do not exclude or limit liability for a breach of contract that is intentional or that damages human life, physical integrity or health, or any other liability that cannot be excluded or limited by law. These Terms do not take away your rights under mandatory consumer-protection rules.

12. Changes to the App and to these Terms

We may update the App and change its features. We may also change these Terms: we publish the new version on this page with a new effective date. A change does not affect earlier purchases; the Terms in force at the time of the purchase apply to them. If you keep using the App after the effective date, you accept the new Terms. If you do not accept them, stop using the App.

13. Ending

You can stop using the App at any time by uninstalling it. Uninstalling deletes the data stored on your phone; your purchases stay tied to your Store account and can be restored. The licence ends by itself if you seriously breach these Terms. The sections on intellectual property, warranty, liability and governing law continue to apply afterwards.

14. Governing law and disputes

These Terms are governed by the laws of Hungary and, where applicable, of the European Union, without regard to conflict-of-law rules. The courts of Hungary decide disputes about these Terms. This does not deprive a consumer of the protection of the mandatory consumer-protection rules of the country where they live; a consumer living in the EU can also go to the courts of their own country.

As a consumer you can also turn to the conciliation body competent for the place where you live, to settle the dispute out of court.

If a provision of these Terms is invalid, the rest remains in force.
